Description

BP INEX Advance (the “Product”) is a water-based acrylic emulsion designed for both interior and exterior wall surfaces, offering a soft sheen finish with superior whiteness, anti-fungal and anti-algal protection, and low VOC content. When used as part of the prescribed painting system on exterior masonry walls, the Product delivers lasting beauty and protection backed by a performance warranty from Berger Paints India Limited (the “Company”).

THE WARRANTY COVER
Description

The combination of BP INEX Advance with WeatherCoat® Exterior Primer or above (the “Painting System”) offers the following warranty on exterior vertical masonry surfaces:

  • A 4-year sliding scale performance warranty on paint failure (as defined herein).
  • A 1-year anti-fungal warranty on fungal and algal growth appearing on the painted surface.

This warranty applies exclusively to exterior vertical masonry walls. Interior surfaces are not covered under this warranty.

Applicability of Warranty
Description

This warranty shall be applicable only when all of the following conditions are met:

a.  Wall Conditions

  • The surface must be an exterior vertical masonry wall — sand-cement plastered, concrete, or similar substrate.
  • The wall must be structurally sound, free from loose flakes, dirt, contaminants, and mould growth.
  • No visible patches, moisture marks, or signs of active water seepage or leakage.
  • Acceptable wall moisture level: up to 12%, and free from visible dampness.
  • Surface pH must be between 7 and 11.
  • Cracks up to 3 mm must be filled with Berger Paints Crack Fill Paste as per the application instructions in the Product Data Sheet prior to painting.

b.  Recommended Painting System

The following sequence of application must be followed:

  • Clean and prepare the surface — remove dust, grease, loose particles, and existing flaking paint.
  • Fill cracks up to 3 mm with Berger Paints Crack Fill Paste; allow to cure fully.
  • Apply 1-2 coats of WeatherCoat® Exterior Primer or above as the basecoat, at the recommended dilution as specified in the product data sheet.
  • Apply 2–3 coats of BP INEX Advance as the topcoat at the recommended dilution as specified in the product data sheet.
  • Allow a minimum of 6–8 hours between each coat.

Note: No vertical surface, including duct areas, should be left uncoated due to inaccessibility.

c.  Minimum Volume Threshold

  • The minimum volume of BP INEX Advance (topcoat) purchased and used at a particular site must be at least 60 litres to be eligible for this warranty.
  • A minimum of 1 coat of the basecoat (WeatherCoat® Exterior Primer or above) is mandatory across the entire painted surface.
  • The topcoat and basecoat must be applied at the dilution ratios specified in the respective product data sheets.

A site visit for pre-inspection by the Company’s representative shall be required where the volume of BP INEX Advance purchased and used at a particular site exceeds 100 litres.

Commencement and Duration
Description
  1. This warranty shall be effective from the date on which the customer has registered the warranty in the manner recommended by the Company and by providing all requisite details (“Commencement Date” / “Effective Date”). Registration must be completed within thirty (30) days from the date of purchase of the Product.
  2. The Company, if deemed necessary, may appoint a representative to inspect and monitor the application of the Product.
  3. The warranty shall be for a period as described in Clause 3 (Warranty Liability) of this document.
  4. Where any claim arises during the warranty period, the period will not commence afresh after settlement of the claim.

Warranty Liability
Description
  1. This warranty only provides for the replacement cost of paint (“Replacement Cost”) as per the reducing scale set out herein, solely for re-application purposes, in order to make good the affected areas. The Company shall, at its sole discretion, decide on providing replacement of the Product or Replacement Cost as per the reducing scale.
  2. Under this warranty, paint failure shall mean, subject to the terms set out herein:

    a. Film integrity failure — flaking or peeling-off of the basecoat and/or topcoat caused by one coat coming off from the other or from the substrate.

    b. Shade fading or blistering, tears, splits, or signs of considerable weathering arising solely due to product quality issues.

    c. Fungal or algal growth appearing on the painted surface covering a minimum continuous area of 10 sq. ft. or more.

 

  1. The Company’s liability will reduce over the warranty period according to the following scale:

  2. Any extra cost borne by the customer shall not be the liability of the Company. The Company shall not be liable for any defects arising out of workmanship.
  3. The Company will not be liable for any indirect or consequential loss or damage to the customer. The customer’s exclusive remedy shall be as described herein.
  4. This warranty on the Product is the sole and exclusive warranty given by the Company. Save and except the warranty set out herein, there are no other warranties whether express or implied under law.

Warranty Exclusions
Description

This warranty shall not be valid in the following cases:

  1. Vertical surfaces not coated with BP INEX Advance.
  2. Water ingress through exterior vertical surfaces on any part of the structure not protected with the Product.
  3. Water leakage or seepage in walls through exterior sources such as broken water pipes, damaged sewerage lines, water leakage from toilets and kitchens due to faulty or rusted pipelines, damage in concrete or brickwork, dripping of water from any source (including vegetation), air-conditioning units and plant pots, or continuous dampness from capillary rise from ground level.
  4. Fungal or algal growth on surfaces other than exterior vertical masonry walls.
  5. Defects in the design of the building including the roof.
  6. Any change in the building or structure post painting.
  7. Failure or damage caused by the previous coating, if any.
  8. Structural defects including cracks up to 3 mm not treated with Berger Paints Crack Fill Paste prior to painting.
  9. Improper surface preparation, including presence of contaminants, moisture, or inadequate curing time for the paint film.
  10. Usage of incorrect shades or wrong bases for tinting colours.
  11. Exposure of the Product to damaging substances including but not limited to solvents, chemicals, acids, strong alkali, or oils.
  12. Mechanical damage or damage of film due to high abrasion with sharp objects.
  13. Damages resulting from leakages arising out of additional installations not consistent with the painting system.
  14. Failure of the underlying plaster, putty coat, or any other coat which in turn causes failure of the Product.
  15. Causes other than defects in the Product.
  16. Reasons not under the control of the Company, including:

    1. Vegetative growth, excessive bird droppings, spitting, or damage caused by insects.

    2. Vandalism.

    3. Acts of God including but not limited to earthquakes, cyclones, floods, or torrential rain.

    4. Normal wear and tear.

    5. Abuse or negligence by the customer.

    6. Failure due to reasons solely attributable to the contractor or painter.

Claims
Description
  1. Any claim made under the terms and conditions of this warranty shall be made within 15 days from the customer discovering any defect, damage, or failure which gives rise to a claim. The decision of the Company to accept or reject any claim lodged under the terms of this warranty shall be final and binding on the customer.
  2. The customer must retain the original invoice(s) to avail this warranty. Upon receipt of a complaint, the Company, at its discretion, shall appoint or authorise a person who will visit the site for inspection and shall verify and confirm that surface preparation and application of the Product have been carried out as per the Company’s directions. If required, it may carry out tests.
  3. The customer shall also retain the original invoice(s) raised by the dealer(s) and/or contractor(s).
  4. Prior to such inspection, the customer shall not have the right to carry out any repair or remove any part of the paint.
  5. The Company’s authorised personnel shall verify that all products prescribed by the Company have been purchased in the required quantities and used as recommended.

General Terms
Description
  1. This warranty is non-assignable and non-transferable.
  2. In case of any dispute, the same is subject to the exclusive jurisdiction of courts at Kolkata.
  3. All parties shall always keep all matters and facts concerning any dispute confidential.
  4. The section headings in this warranty are for convenience of interpretation only and do not have any legal or contractual effect.
